Will Murray Professional Corporation

Defending yourself against allegations involving violence and the threat of violence begins with putting together all the relevant facts. Rarely does the story presented by the police accurately reflect exactly what happened. As your lawyer, I need to establish what the Crown can actually prove and what other factors should be raised to provide you with a defence in law. Crimes alleging violence are taken very seriously in the justice system, and you need someone with experience to present your case effectively.

Bail hearings, also known as “Show Cause” hearings or Judicial Interim Relief, can be the most important stage in the legal process. If we can obtain bail to get you out of custody, you can improve your circumstances and dramatically change your final outcome. Securing the release of the person charged can involve putting a plan together and having sureties testify at a hearing to demonstrate that appropriate bail conditions can work. This is where family support or other community involvement can make all the difference. If you are, or if someone you love is, in police custody, I can help with a plan to get bail.

Breaches and administrative charges may seem trivial, but these offences bring serious consequences, such as a criminal record. Sometimes an outstanding breach can be harder to deal with than the original substantive charge. We might need to vary the conditions of release.

Armoured Suits: Criminal Defence Lawyers

In its most common form, assault is when one person applies or threatens to apply force directly to another person. Think a punch or a slap, or telling someone you’re going to beat them up. In the case of threatening someone, the person threatened has to believe that the aggressor has the ability to act on their threat immediately. For instance, threatening someone with a cocked fist while standing right in front of them is different than doing it from the other side of a crowd.

A Break and Enter is considered a serious (indictable) offence and punishment can be severe. If the break and enter is committed in relation to a dwelling house, the accused is liable to a maximum sentence of life imprisonment. As per Section 348.1, the fact that the dwelling house was occupied (and that the accused knew that it was occupied) at the time of the offence qualifies it as a home invasion. This becomes an aggravating factor when it comes to sentencing.

Illegal firearms possession is the most common firearms related criminal charge, and is categorized as a hybrid offence with the potential to be pursued either as an indictable offence or summarily. Under section 91(1) of the Criminal Code of Canada, it is illegal to possess a firearm without having a license, and if the firearm is considered to be restricted, the license must be accompanied by a registration certificate. An exception to unauthorized possession exists where a person possesses a firearm under the direct supervision of the lawful owner and operator of the firearm.

If you have been arrested for a crime or you have been contacted by police about an alleged offence, you need to know what your rights are and how to assert them. Given that these events can have a significant and lasting impact on your life, it is common to feel frightened and confused by the process.

After being stopped and arrested for impaired driving in Ottawa, knowing what is involved is important and can help ease your fears about the process. You may have questions about your driver’s license, your criminal record and whether you will face large fines and jail time.

At Engel & Associates, we can help to defend your rights if you have been stopped for impaired driving or a related charge in Ontario. Our lawyers have achieved countless victories for our clients who have been charged with these offences by getting the consequences minimized or reduced.

In Ontario, people who drive under the influence of alcohol are often charged with both impaired driving and “Over 80.” Over 80 refers to driving with more than 80 milligrams of alcohol in 100 millilitres of blood. A conviction for any drunk driving charge can come with significant penalties, including fines and a permanent criminal record for a first offence.

Shore Johnston Hyslop Day LLP

Sometimes tensions within a relationship boil over and lead to allegations of physical aggression or property damage. Other times, partners are in the midst of a separation, divorce, or relationship breakdown and verbal arguments escalate. Often those facing domestic assault or mischief charges are first-time defendants, never having been involved with the criminal justice system before.

Whatever the situation, those charged with domestic assault or offences of domestic violence need effective representation to ensure that they are not burdened with a permanent criminal record or other negative consequences that could follow from these types of allegations, such as issues with the Children’s Aid Society and custody and access. Our lawyers have considerable experience with domestic assault and mischief allegations. We thoroughly investigate and cross-examine complainants and other prosecution witnesses to ensure that the judge or jury hears the whole story.

Sexual assault offences carry some of the most serious penalties in the Criminal Code. Jail time is usually the sentence sought by the prosecutor if a person is convicted of a sexual assault offence. A person who has been convicted of sexual assault must also comply with the Sexual Offender Information Registration Act (SOIRA) for at least ten years and potentially for the rest of their life. The stigma that attaches to a sexual assault accusation can be enough to destroy a person’s life. Given this, it is essential that those charged with sexual assaults have a vigorous defence.

David Anber’s Law Office

Having a lawyer is more than just fighting in Court. It is many things. It includes arguing to a judge in Court, but it also includes preparation for Court, written arguments, negotiation with the prosecutor, strategic decision making, using the media where appropriate, etc. At David Anber’s law office, we pride ourselves on offering strong advocacy services which are tailored to the specific need of the case.

Alcohol-related driving offences are the most common offences before the Courts in Ontario and Quebec. “Alcohol driving offences” refer to “over 80”, Impaired Driving, Fail to Provide a Breath Sample, DUI, “care and control” and breathalyser refusal cases.

It is quite intimidating to be told that a breath machine has put you over the legal limit. Every week clients come into David Anber’s Law Office and say “why should I bother fighting it – the machine says I’m guilty”.

Where most people plead guilty, the lawyers at David Anber’s Law Office know that there are hundreds of ways that an Impaired Driving prosecution can fall apart. Our job is to try and find those important details to create a game plan that has a chance to win. For this reason, after a careful “risk/reward” analysis, we almost always recommend to our clients to proceed to trial.

Over the years, our criminal defence and appeal lawyers have been sought out by clients from across Ontario, and from all walks of life. We represent executives, civil servants, doctors, pharmacists, high-tech workers, and diplomats. Our clients also include institutions and organizations facing criminal or regulatory issues.

But we also believe quality representation should not only be available to those who can easily afford it. We have the flexibility to accommodate clients who might otherwise struggle to pay for top-flight legal representation. And, in appropriate cases, we accept Legal Aid.

To win an appeal in Ontario, your criminal appeal lawyer must be a master of the written word, a creative legal thinker, and a persuasive oral advocate. To conduct an appeal effectively, a criminal appeal lawyer needs to know not only the law that applied at trial, but the specialized laws and procedures that apply only to the appeals process.

Appeals are not for beginners. Unlike a trial, criminal appeals are about finding legal errors. Without a legal error, even if the appeal court has doubts about your guilt, it will not overturn your conviction. Being innocent isn’t enough. Added to that, an accused who has been convicted is no longer presumed innocent. The person who brings the appeal bears the burden to prove that the conviction or sentence was flawed. The best criminal appeal lawyers can find errors that others will miss, and are masters at framing the facts and the law so that the appeal court will understand that the error at trial made a difference in your case.
